Personal Bankruptcy and Health Care Reform

Whether you prefer your news on FOX or NPR, there is no denying that the air is thickening around the subject of health care reform in this country. Arguments favoring this tinker or that tamper satisfy some and enrage others. Regardless of what approach people favor, there is one unifying acknowledgement: It is that some meaningful reform must soon be in place before the current system bankrupts our nation.

In fact, many individual Americans have already been bankrupted through devastating encounters with our current health care system. This past summer, the respected American Journal of Medicine released new study findings that revealed some staggering statistics that reveal the role that medical expenses play in personal bankruptcy filings. Working to reduce the margin of error in their findings, the authors applied a stringency to the study that made it a first of its kind: a truly random sample of bankruptcy filers nationwide, followed up with detailed personal interviews of participants. Medical causes of bankruptcy were defined to include medical bills and loss of income due to health issues. In conclusion, they discovered that more than 60% of personal bankruptcy filings in 2007 had significant medically related expenses that pushed individuals and families over the financial edge to file for bankruptcy.

CNN interviewed an author of the study, Steffie Woolhandler, M.D. who made this concluding comment: "If an illness is long enough and expensive enough, private insurance offers very little protection against medical bankruptcy, and that's the major finding in our study." A comment coming from the D.C. based nonpartisan Center for Studying Health System Change in response to the American Journal of Medicine's study held some skepticism about what actually precipitated the bankruptcy filings but did own that medical expenses were a key player, considering that 1 in 5 American families are "unduly strained" by medical bills.

In the 20 year span from 1981 to 2001, there was a major jump in the percentage of families filing for medically related bankruptcy, a rise from 8% to 46%. The earlier numbers may not have accurately reflected the role of medical bills in the bankruptcy filings, because court records were the means through which the statistics were gathered. Court records do not include the origin of debt that was owed to collection agencies, quite possibly obscuring the role of medical bills. Nevertheless, the American Medical Journal's most recent 2007 figures of nearly 62% medically related bankruptcy, indicate an unprecedented escalation over a 6 year period. Add that trend to what is still the unknown fallout of our economy's current recession and we may have some even more frightening revelations.

The popularly held mental picture of the average personal bankruptcy filer as a shiftless individual is completely dispelled by the AJM study. In this nationwide random sample, the majority of debtors were middle aged, middle class and college educated. The majority, 75%, had medical insurance policies when their debt and health problems started. Their insurance had the industry's standard gaps of copayments, high deductibles and services that were not covered. Nationally, 50% of insurance companies rescind individuals' policies within one year of being diagnosed with a disabling condition and many are immediate cancellations.

It is hard to ignore that the middle class' back is being gradually broken under the weight of the current insurance system. Health insurance premiums skyrocket every six months and deductibles on most policies follow a similar skyward pattern annually. Proponents of the American Dream have traditionally contended that what is bad for the middle class is bad for the nation as a whole. Currently, it is estimated that the U.S. will spend 17.6% of its GDP (Gross Domestic Product) on health care in 2009. The future holds an ever upward spiral if reforms are not soon brought into play. A further consideration of this staggering GDP statistic is to realize that it does not and cannot take into account all the associated costs that medically related bankruptcy of individuals or small businesses impose on the economy and society.

One of the most critical decisions to make when you want to a home is to time the interest rates exactly right. Those who think rates will increase want to buy sooner and take advantage of currently lower rates, and those who think they will go down want to wait until a more opportune time.

The interest rate on your home loan will be influenced by many variables and economic indicators, and having a basic concept of these will help you in your choice. Interest rates are actually the price of money, and just as the law of supply and demand dictates price, the law of supply and demand will influence the price of your mortgage: its interest rate.

The most important predictor of interest rates is inflation. There are two major culprits when it comes to inflation. The PPI (Producer Price Index) and the CPI (the Consumer Price Index).

PPI is the measure of differences in prices in a given period for goods at the production level. Increases in the Producer Price Index means higher prices for finished goods, and that means inflation.

CPI is the measure of the change in prices at the consumer level, measured as a group of goods. This is a very critical signal of inflation since it is what we will all pay for our goods. The so called ?basket of goods? used is steady so that economists can see how prices change, but since food and energy are included, they are often eliminated to reduce volatility. The volatile categories of food and energy can skew the inflation rate, while core inflation will give a better measure if overall prices are on the rise, causing inflation.

GDP is another fairly good predictor of inflation as well as interest rates. The Fed (Federal Reserve Bank-the Central Bank of the United States) is responsible for keeping the economy on an even keel-not a lot of growth, which will cause inflation and not too little, which may cause a recession. The Fed has the tools to intervene in the economy in a number of ways so that it can decrease rates to slow the economy down and increase rates to speed it up.

The unemployment level also has an influence on interest rates. If the economy is experiencing low unemployment, inflation will probably follow since salaries have to go up to attract candidates. If the economy has high unemployment, interest rates will fall because salaries will fall because employers do not have to offer higher salaries to keep employees. Lower wages mean lower prices which means lower inflation.

Keeping track of these interest rate indicators will assist you to choose when it is a good time to enter the home loan market. The rule of thumb is that a slow economy with high unemployment will mean that rates will be falling. Conversely, higher GDP and lower unemployment will mean an increase in interest rates.

WhatAre ARMs All About?

You have a lot of choices to make in purchasing a house and deciding upon a home loan, and in today's confusing mortgage world, you now also have to choose the index that you want for your Adjustable Rate Mortgage (ARM).

When we talk about the index for the ARM, we are talking about the instrument that the adjustments to the mortgage rate will be tied to. Various indices are used, including government treasury instruments, the Fed Fund rate or LIBOR.

The rate on an ARM is adjusted periodically upwards, or downwards, based upon the movement in the general interest rate market, but tied to a specific instrument. If your ARM is tied to the CD rate, and the bank's CD rate goes up, your interest rate will likewise go up. Another feature of an ARM is that there is an adjustment cap, which prevents the interest from moving up or down too often, even if the index does; sometimes this is an advantage if you just adjusted and then rates move upwards. By the same token, if your adjustment is scheduled to take place immediately after the CD rate increased, you will have that rate for a while, even if the CD rate comes back down in the meantime.

The list of instruments that ARMs can be linked with reads like alphabet soup today, from CDs to LIBOR. The Fed Funds rate is the most used index for ARMs. Another popular index used by a lot of lenders is the LIBOR, or the London Interbank Offered Rate, which highly rated international companies pay to borrow.

Which is the right choice depends on your situation circumstances and your view of where interest rates are heading. CD ARMs adjust every six months, for example, and therefore react more readily to interest rate changes. On the other hand, if your ARM is based on T Bills, it will react more slowly. Fastest of all in reaction time is the LIBOR, so if you feel that rates are falling and want to take advantage of each downward move, this is the one for you.

As we said, new products are introduced each day, and one of the newest it the option ARM, which allows the borrower to choose how much he wants to pay on his mortgage each month. There is a minimum payment that covers the interest (so the bank gets its money) and then the other options will pay down some portion of equity. There is a real danger in option mortgages that the loan will end up with negative amortization, which means the mortgage balance increases instead of decreasing as it normally would.

With all of these choices, a prospective borrower should be sure to talk to a professional mortgage consultant who understands the various products and can help you choose the best one for you.

Skills to Help You Rehab a Home

Drywall/ Plaster Repair When rehabbing old houses, cracks and holes in the plaster are common. Often, holes in ceiling plaster are the result of water infiltrating either from the roof, or from a split plumbing line. Holes in walls are often the result of vandalism, but could be the sign of more serious foundation issues. Once the root cause is fixed (see basic water repair section) cut a square area and replace with inch drywall. Once your piece is cut, secure it with multiple drywall screws, mud the gaps, tape, re-mud then sand to a smooth finish.

Basic Water Pipe Repair Many of the foreclosed homes that I encounter have sat over the winter and the cold weather has burst water pipes in the basement and walls. Usually the hardest part of the repair is finding all the leaks. You do this by turning on the water, listening for falling water, then visually inspecting where the water is coming from. Once you find the leak, cut out the old section of pipe and cut a section of new pipe to replace it. Rough up the end of the old and new sections of pipe with your sandpaper. Apply flux to each section of pipe and to a coupler that will be used to join the pieces. Put the new section in place. Heat the coupler with your butane torch and apply solder around the edges of the coupler. The flux will melt creating a vacuum inside the coupler and drawing the solder inside. Once it is sealed all the way around, allow the solder to dry and move on to the next leak. If you are worried about using a butane torch on this project, ask your hardware professional about Shark-Bite fixtures.

Drain Repair Clogged drains are a very common problem. When a working drain gets clogged, Draino or a quick snake will often do the trick. If that doesn't work, unscrew the drainpipe and inspected for clogs. In a vacant house, a clog can become impenetrable. If you encounter such a clog, you need to cut it out and replace that section of drain. Once the clog is cut out, cut a similar length of PVC pipe to replace it. Either connect the new pipe to the old with PVC connectors or with a fernco connector. If you use the PVC connectors make sure that you clean the old pipe thoroughly and apply PVC cement to ensure a proper seal. Many plumbers apply pvc cement or pipe dope even if the pieces they are putting together are threaded.

Replacing Light Fixtures Be sure the power is off to the fixture by checking the wires with a voltage meter. Remove the old fixture. Strip off a section of the wire casing and attach your new fixture with wire nuts and electrical tape. Insure that no unexposed wire remains. Since each fixture will come with its own set of instructions, be sure to read those instructions thoroughly to insure proper installation. Electricity can cause severe injury if you do not follow instruction implicitly.

Window Installation Carefully remove the old window. Be sure not to damage the old wood frame and the window sill. Once the window is removed place wood shims on the exterior of the sill and level the shims. Secure the shims. Place the new window in the opening. Place more wood shims along the sides at the top, middle and the bottom. Once the sides are secure, make sure you can easily open and close the window. Fill the gaps around the window with expanding foam insulation or fiberglass insulation.

Refinishing Wood Floors Almost every house I buy has stained, smelly tattered carpet covering stained hardwood floors. Rather than re-carpet the floors, I like to refinish the hardwood. First remove the old carpet. Then remove all of the tack strips, staples, nails and quarter round molding. Once the floor is clean, run your drum sander with the grain of the wood. Make sure that you get a thorough explanation from the rental yard on the operation of the drum sander and that you understand it completely before you begin this project. Working a drum sander is a lot like working a self-propelled lawn mower. It is very important that you keep the drum sander moving at all times though. If you leave it sit it will quickly eat into the floor. I start with 36-grit sandpaper, then 80-grit, and then 100-grit. Once the main body of the floor is sanded, do the edges with an edge sander using the same grits of sandpaper that you used on the main floor. When all the sanding is complete, sweep the floor, and then vacuum the floor. After vacuuming, I suggest a damp mopping. Once the floor is dry apply your choice of stain, Allow to dry then coat with 2 - 3 layers of polyurethane. Replace the molding.

Laying Tile Start by removing the old coverings whenever possible. Once the old covering has been removed put down a cement backerboard over the entire area to be tiled. Fill in the joints of the backerboard with mortar. Begin tile installation by troweling on a thin application of mastic over a three to four foot area. Set the tile in place and push gently to secure the position. Continue in this fashion until the tiles are all in place. Allow the mastic to dry for 24-hours before grouting. If you are laying a natural stone tile be sure to seal the tile prior to grouting. If you don't, the tile will appear hazy. Remove all tile spacers. Mix the grout and push the grout into the seams using a rubber float. Immediately wipe up excess grout with a damp sponge. After an hour or so, wipe down the tile with a piece of cheesecloth to get rid of the haze on the surface.

Texturing a Ceiling Texturing a ceiling is one of the simplest jobs you will do on a home, yet it gives the room a finished look. Dip a texturing brush with a long (4 foot) handle into a bucket of top-coating mud. Push the brush into the ceiling in a random pattern. After it dries finish by painting with a white ceiling paint. (Note: This project can be messy. Either do it before you put your floors in or cover them completely. )

Painting a Room Two tools that will make painting a room faster, easier and produce a better result are an orbital sander and a power sprayer. Use the orbital sander to smooth out any surface imperfections. Once the walls are smooth, start spraying. First, spray the walls, and ceilings with a coat of latex based primer. Next spray your ceiling with a white ceiling paint. Then spray your walls with a flat paint. Flat paint is the best choice for hiding small imperfection in your walls surface. Be sure to follow the sprayer with a roller to produce the best results. For a great finished look, be sure to apply a fresh coat of white semi-gloss paint to all trim.

Landscaping The exterior is the first impression people will get of your house. Take time to remove all the overgrown 1950's era plants and replace them with smaller more modern looking plants. After removing the old shrubs, cultivate the bed and mix in organic materials like manure, compost or peat moss. Arrange your new plants on top of the beds. Once you are happy with the arrangement, remove any burlap or plastic and plant them. Be sure not to bury the root balls of shrubs. You want to plant the shrub with just a little of the ball showing above the ground surface. Follow spacing instruction on the containers so that your new landscape doesn't look like overgrown in two years. After planting the large landscape in this fashion, take time to plant flowers around your new plants and enjoy your new look.

IRS Provides Guidance on New COBRA Rules

Those individuals are required to pay only 35% of the group health insurance premium that would otherwise apply.

Under the IRS Act, the "person to whom the premiums are payable" - generally, the employer - pays the other 65% of the COBRA continuation premium. The employer module then be reimbursed by means of a federal payroll tax credit claimed on Form 941.

The Payroll Credit Generally, an employer can claim the payroll credit for the COBRA payment subsidy on Form 941, Employer's Quarterly Federal Tax Return. To do so, the employer should enter the amount of any COBRA payment assistance payments paid on behalf of employees for that lodge on Line 12a. The amount entered should equal 65% of suitable workers' total COBRA payment payments - not amounts received from past employees.

In its Guidance, the IRS indicated that there has been some confusion surrounding the proper number of individuals to be reported on Line 12b as having received COBRA premium assistance reported on Line 12a. The guidance clarifies that only one individual should be counted for Line 12b purposes in a situation where a former employee has also secured coverage for other qualifying individuals such as a spouse and/or children.

Timing Issues: The IRS has also clarified that the COBRA premium reduction applies as of the first period of coverage beginning on or after February 17, 2009, for which a qualifying involuntary terminated employee is eligible to pay 35% of the premium. The exact date of coverage is contingent upon the period to which premiums are charged to the plan. The 35% premium subsidy generally applies until the earliest of three events: (1) when the former employee secures other health insurance coverage; (2) the date that is nine months after the first day of the first month for which the special COBRA premium subsidy provision applies; or (3) the date the individual is no longer eligible for COBRA continuation coverage.

The Facts About ACL (anterior cruciate ligament) Reconstruction

When you tear the anterior cruciate ligament in your knee, your doctor will probably recommend ACL (anterior cruciate ligament) Reconstruction surgery. When this is the case, it is important that you understand that the tissue to be used in your surgery can come from a variety of sources.

You may wonder where this tissue will come from. There are a couple of ways to get tissue for an ACL (anterior cruciate ligament) reconstruction. One way is to take the tissue from the patients body. This is called an autograft. The tissue is usually taken from the hamstring or the patellar tendon. This is the tendon at the front of the knee.

Allograft is another type of graft. This tissue is harvested from a cadaver.

There are both advantages and disadvantages to the use of each type of graft. Your surgeon will determine which type will work best for you.

ACL (anterior cruciate ligament) Reconstruction surgery is normally performed with the use of an arthroscope. To perform knee arthroscopy, your surgeon will create a small poke-hole in your knee and insert a tiny camera. This camera is connected to a video monitor and allows your surgeon to see the inside of your knee.

While your surgeon is looking, he or she will check for damage to other tissues. If the cartilage or ligament in your knee has been otherwise damaged, that problem will also be attended to during your procedure.

Several types of anesthesia are used for arthroscopic knee surgery, but you will probably receive general anesthetic. This will allow you to sleep during the surgery. While you are sleeping, your surgeon will replace your ACL (anterior cruciate ligament).

If you will be using an autograft, an incision will be made to remove it. Aside from that, knee surgery using arthroscopy requires only very minimal, small incisions. These are used to remove the damaged ligaments and to place the new ligaments properly.

Your surgeon will create bone tunnels to be used in placing the new ligament in the exact location of the old ligament. Once the bone tunnel is in place, your new ligament will be positioned and attached to the bone with screws or some other form of fastener. This will hold the ligament in its proper place. At the end of surgery, your surgeon will close your incisions and apply a bandage.

One advantage of arthroscopy is that your surgeon can create a complete and accurate video record of the procedure and review it with you afterwards. You will be able to watch the surgery on a video monitor and talk with the surgeon about any questions or concerns you may have.

To be considered for ACL (anterior cruciate ligament) reconstruction, some symptoms you might be experiencing include, knees that give way, weakness and instability in the knees, and knee pain. If your ADL (activities of daily living) are affected and/or you are not able to participate in sports as you wish, these are further reasons to consider ACL (anterior cruciate ligament) reconstruction.

Complications are rare with this type of surgery; however, they do exist. Some things to keep in mind are the possibility of: Failure to heal, failure to relieve symptoms, stiffness and pain in the knees, continued weakness in the knees, infection at the site of the surgery, nerve damage, and bleeding.

Basics of Rotator Cuff Injuries

Of musculoskeletal injuries, rotator cuff injuries are one of the most frequent. A rotator cuff injury is quite painful and can cause shoulder weakness; however, it does not cause swelling. Interestingly, patients often do not have symptoms. Most of the time; however, the patient will experience pain and weakness during activities involving the arms. Raising the arm above shoulder level can prove particularly painful. On the bright side, there are quite a few ways to treat rotator cuff injuries. Your age and the type of injury you have will help determine which option will work best for you.

In addition to the two types of rotator cuff injuries already mentioned - tear or tendonitis - you should be aware that there are other conditions that may exhibit similar symptoms. Be sure to see your doctor to get the right diagnosis. He or she will give you a physical examination and will probably inject your shoulder with a local anesthetic. These procedures help your doctor to determine exactly what is wrong with your shoulder. If your doctor believes that you have a rotator cuff tear, the next step may be imaging tests to confirm the diagnosis and find the exact location of the tear.

It is far more common for the diagnosis to be rotator cuff tendonitis; however, the treatment for tears is very similar to the treatment for tendonitis. Both can be treated conservatively with what is known as RICE therapy. That is: rest, ice, compression, and elevation. You may also want to use an over-the-counter pain medication like ibuprofen. Additionally, your doctor may give you a referral to a physical therapist to learn how to modify your movements and to get a list of exercises that may be beneficial to you. If your tendonitis pain persists, your doctor may give you injections of a steroid/anesthetic mixture. These would be administered to the joint to relieve pain.

This sort of non-surgical intervention usually has a 50-50 chance of being effective. If it is to work, you will probably see results in 6 - 12 weeks. Using non-invasive techniques of this sort can be good in a number of ways. When you do not have surgery, you also do not have recovery time. Furthermore, you do not experience any of the risks commonly associated with surgery such as complications caused by anesthesia, permanent stiffening of the joint, or infection. One thing to realize, however, is that this approach can cause the original tear to increase in size. Additionally, even though there is not a set recovery time, you will be operating at less than your usual ability until you have completely recovered. Aside from these considerations is the fact that non-invasive techniques may not be effective. You may end up having surgery after all. If your injury is quite severe, your doctor may bypass the non-invasive option and recommend surgery right from the start.

Rotator cuff injuries can be treated surgically in three ways:

1. Open repair surgery: With this option, the surgeon makes a full incision into the shoulder. This method gives the surgeon a great deal of freedom of movement; however, it is the largest incision option of the three available methods.

The second method is mini-open repair surgery. While this method is similar to open repair surgery, it differs somewhat in that it utilizes arthroscopy. The use of arthroscopy allows the surgeon to make a smaller incision, leaving a smaller scar. This method is an outpatient procedure.

The third method is known as all arthroscopic surgery. This is the simplest option in that it is an outpatient procedure, and it also leaves the smallest scar.

After examining and diagnosing your injury, your doctor will be able to make a sound decision as to which method will work best for you.

Happily, rotator cuff surgery is a highly successful surgical procedure. Eighty to ninety-five percent of patients who have this type of surgery report successful results, improved range-of-motion and a significant decrease in pain in six months or less.

The expertise of the surgeon is a very important factor in the successful outcome of the surgery. However, there are some variables to keep in mind when considering speed and success of recovery. Among them are the type of tear, tissue quality, the patients age, and the amount the patient complies with the doctors instructions.

Complications resulting from rotator cuff surgery are quite rare. The most commonly experienced complication is tendon re-tear. This is only experienced by about six percent of patients. Nerve injury may be experienced by one to two percent of patients. Infection may be a problem for one percent of patients. Fewer than one percent complain of stiffness. Less than one percent may have problems with deltoid muscle detachment.

Obama's new health care revolution offers many benefits that Americans have never wanted nor opted to pay for themselves. It allows the government to decide the rate and the summary of benefits without consulting the actual people it would cover; not quite by the people and for the people.

The proposed community rating means that all people would have the same insurance rate regardless of lifestyle choices. No longer would the choice for a healthy existence be beneficial. A one size fits all type plan where Americans relinquish their demand for choice having no Preferred Provider Organizations (PPO), Health Savings Account (HAS), nor a capitalistic economy which now exists for senior Medicare supplements. The intentions of this plan stand in question as speculation is made on Obama responding with a yes to the preliminary health questions on tobacco use.

In light of his dialogue with students, some might dispute the need to make young people conscious of the toil they will face as they move from adolescence to adulthood. According to Forbes magazine college graduates will walk away from his or her university with a minimum of $20 thousand in dept and an yearly income of $30 thousand.
